Welcome to Traccion. These Terms of Service ("Terms") govern your access to and use of the Traccion website, dashboard, and services (collectively, the "Services") provided by Traccion ("Traccion", "we", "us", or "our"). By signing up for or using the Services, you agree to these Terms.
1. The Services
Traccion provides AI-driven business tools for local service businesses, including an AI phone receptionist, AI search visibility tracking and optimization, custom software builds, and AI marketing services. The specific features available to you depend on the plan you select.
2. Eligibility and accounts
You must be at least 18 years old and authorized to act on behalf of the business you register. You are responsible for all activity under your account and for keeping your login credentials secure. If you suspect unauthorized use, contact us immediately at [email protected].
3. Subscriptions, fees, and billing
Paid plans are billed monthly in advance through Stripe. Setup fees, where applicable, are charged once at activation. Some plans include a usage cap (e.g., minutes for the receptionist); usage beyond the cap is either rate-limited or billed at the per-minute overage rate disclosed on the pricing page at signup.
Subscriptions auto-renew until you cancel. You can cancel any time from your dashboard or by emailing us; cancellation takes effect at the end of the current billing period. Setup fees and monthly fees already paid are non-refundable except where required by law.
4. Your content and your customers' calls
You retain ownership of all content you provide (business info, scripts, FAQs, recordings). You grant Traccion a limited license to process that content solely to provide the Services. Call recordings and transcripts are stored to power the receptionist and surfaced in your dashboard. You are responsible for complying with applicable call recording laws and for disclosing recording to callers where required.
5. Acceptable use
You agree not to use the Services to:
- Place or facilitate outbound telemarketing or robocalls.
- Send unsolicited SMS or violate TCPA / A2P / toll-free rules.
- Mislead callers about whether they are talking to an AI when asked directly.
- Provide medical, legal, financial, or other regulated advice through the AI.
- Probe, scan, or test the vulnerability of our infrastructure without prior written consent.
- Resell or sublicense the Services without our written permission.
6. Third-party services
The Services rely on third-party providers for telephony, AI model inference, transcription, text-to-speech, payment processing, transactional email, citation and directory networks, and managed database hosting. Their performance, availability, and pricing changes may affect the Services. We are not responsible for third-party outages or changes but will use reasonable effort to maintain continuity. A current list of sub-processors is available on request.
7. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may modify, add, or remove features, and we may update these Terms by posting a new effective date and emailing material changes. Continued use after changes means you accept them.
8. Termination
We may suspend or terminate your account for material breach of these Terms, abuse, fraud, non-payment, or to comply with law. On termination we will provide a reasonable window to export your data.
9. Disclaimers
The Services are provided "as is" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated outputs may be wrong; review them before relying on them for binding decisions.
10. Limitation of liability
To the maximum extent permitted by law, Traccion's total liability arising out of or relating to the Services in any 12-month period is limited to the amount you paid us in that period. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold Traccion harmless from any claim, liability, or expense arising from your use of the Services, your content, your customers' interactions with your receptionist, or your violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Exclusive venue for any dispute lies in the state and federal courts located in Los Angeles County, California.
